Motor vehicle accidents and Accident Benefits

Every Ontario auto-insurance policy includes Statutory Accident Benefits (SABS) that pay for treatment, attendant care, lost income and other expenses regardless of fault. Filling out the OCF forms correctly, on time, and with the right medical evidence is the difference between a claim that pays and one that gets denied. We file your OCF-1 (application), OCF-2 (employer's confirmation), OCF-3 (disability certificate) and the supporting medical documentation correctly the first time.

Where another driver was at fault, a separate tort claim can be brought for pain and suffering, future income loss, future care, and family-law-claim damages. The tort threshold and the statutory deductible apply, but for serious injuries the recovery is often substantial.

Slip and fall claims

Ontario's Occupiers' Liability Act requires property owners and tenants to take reasonable care to keep their premises safe. We act for clients injured in falls at GTA shopping plazas, condominium common areas, restaurants, ice-covered parking lots and rental properties. A 10-day notice is required for falls on municipal sidewalks and snow-and-ice claims against many occupiers — call us immediately.

You sign a contingency agreement at the outset. Ontario law requires the agreement to be in writing and to comply with the Solicitors Act; we walk you through every line before you sign.
