The Ontario civil litigation roadmap

Most contested civil files in Ontario follow a familiar arc:

  1. Pre-litigation strategy. A clear demand letter, limitation-period review and risk analysis often resolves matters before a claim is filed.
  2. Pleadings. A Statement of Claim or Application is issued and served; the defence answers.
  3. Discovery. Documents are produced, witnesses are examined, and the case theory is tested.
  4. Mediation. Mandatory in Toronto, Ottawa and Windsor — and statistically the most common point of settlement.
  5. Pre-trial and trial. Where settlement is not possible, the matter proceeds to a judge or jury.
  6. Enforcement. Judgment is collected through writs, garnishment or examination in aid of execution.

Limitation periods are unforgiving

Ontario's Limitations Act, 2002 generally gives you two years from the date you discovered (or should have discovered) the claim. Miss that window and a perfect case becomes unenforceable. Some claims have shorter notice periods — ten days against a municipality for slip-and-fall, sixty days for a construction lien. Call us early, even if you are not sure you want to sue.
