Family & Civil Mediation Across the GTA

Mediation is a confidential, neutral process where a trained third party helps two or more sides reach an agreement they design themselves. It is the most widely used dispute-resolution tool in Ontario family and civil practice because it works: most mediated files settle, settle faster than court, and produce agreements the parties actually follow.

Family mediation

In family files, mediation can cover parenting plans, child and spousal support, equalization of net family property, division of the matrimonial home, and post-separation tax planning. Mediation always begins with a confidential screening to check for safety, capacity and power imbalances. From there, the parties move to joint sessions — in person or by video — and a written Memorandum of Understanding is prepared at the end. Once both parties get independent legal advice on the memorandum, it becomes a binding separation agreement.

Civil and commercial mediation

Civil mediation is mandatory in Toronto and several other Ontario regions before a case can move to trial. We act for clients in shareholder disputes, contract claims, real estate litigation, construction lien matters and estate disputes. A focused half-day or full-day mediation often settles a file that would otherwise consume two more years and six figures in costs.

Open vs. closed mediation

  • Closed mediation is fully confidential. Nothing said during the sessions can be used in court. This is the standard for most family and commercial files because it lets parties test creative options without risk.
  • Open mediation produces a report from the mediator that can be filed in court. It is occasionally used in custody and access matters, but the loss of confidentiality is a meaningful trade-off.

What to expect from your first session

Most mediations open with a joint statement of issues, followed by an exchange of disclosure and a structured discussion of each issue. The mediator does not impose an outcome — they manage the conversation, surface options and reality-test proposals. Many files settle in one to three sessions of two to three hours each. Costs are typically split evenly between the parties.
