Health Law & Regulatory Defence for Ontario Healthcare Professionals
Regulatory complaints and investigations are an occupational hazard for every healthcare professional in Ontario. The College of Physicians and Surgeons (CPSO), the College of Nurses (CNO), the Royal College of Dental Surgeons (RCDSO), the Ontario College of Pharmacists and the other regulators created under the Regulated Health Professions Act all share the same investigative powers — and the way you respond to the first letter often determines the entire outcome.

How regulatory investigations work
Most matters begin with a letter from the College enclosing a patient complaint and inviting a written response. That response becomes the central document in every later proceeding. We help you understand the issues raised, gather the right records, and craft a response that is respectful, accurate and protective of your practice. ICRC decisions can range from no action, to written advice, to a caution, to a Specified Continuing Education or Remediation Program (SCERP), to a referral to the Discipline Committee.
Discipline proceedings
Discipline hearings are public proceedings with significant consequences — including suspension, conditions on practice and revocation. They are also resolvable: many matters settle on an agreed statement of facts and a joint submission on penalty that protects the member's livelihood. We have appeared in proceedings under most of Ontario's health colleges and understand the procedural and tactical considerations involved.
Hospital privileges
Decisions affecting a physician's hospital privileges are subject to the rules of natural justice and the appeal mechanisms set out in the Public Hospitals Act and the hospital's by-laws. Strict timelines apply — many privileges matters are lost because the deadline to request a hearing was missed.
