Most people only deal with employment law during the worst week of their working life — the day they are terminated, or the day they are forced to walk out of a toxic workplace. Our job is to make that week as short as possible and to recover the severance you are actually owed under Ontario and federal law.

Severance — what you are really entitled to

Most Ontario employers offer the bare minimum: the notice and severance set out in the Employment Standards Act, which is typically only one week per year of service. The common law entitlement is usually far higher — often three to four weeks per year, with strong upward push for older employees, longer service, senior positions and a difficult job market. Twenty-four months is the practical ceiling for most non-executive roles.

Whether your employment contract validly limits your entitlement is the central question in almost every termination file. Ontario courts have struck down a long list of termination clauses over the past five years — including in Waksdale, Render, Rahman and others — for failing to comply with the ESA. We pressure-test every contract before recommending a settlement number.

Constructive dismissal

A unilateral change in compensation, role, reporting structure, hours or location can amount to a constructive dismissal — legally treated as if the employer fired you. Constructive dismissals are timing-sensitive: if you stay too long and don't object in writing, you can be found to have accepted the change. Call us before you decide whether to resign.

Workplace human rights, harassment and reprisal

Ontario's Human Rights Code and Occupational Health and Safety Act protect employees from discrimination, harassment and reprisal. Claims can be filed at the Human Rights Tribunal of Ontario, the Ministry of Labour, or as part of a wrongful dismissal action. Damages for human-rights breaches are paid in addition to severance.
