Collaborative Family Law in Toronto & the GTA
Collaborative family law is a structured, out-of-court process where both spouses and their lawyers commit, in writing, to resolving every issue by negotiation. It is widely used across Toronto, Scarborough, Markham and Vaughan because it produces faster, cheaper and more durable settlements than contested court — especially in families with children or shared businesses.
How the collaborative process works
The process begins with a Participation Agreement signed by both spouses and both lawyers. That contract has one critical clause: if the matter ever ends up in court, both collaborative lawyers must withdraw and new counsel must be retained. This is a deliberate financial and emotional incentive that keeps everyone focused on settlement.
From there, the parties work through a sequence of four-way meetings covering goals and interests, full financial disclosure, options for parenting and property, and finally the binding settlement. Where helpful, the team adds neutral professionals — a family professional to support communication or a financial neutral to model support and equalization scenarios.
